We, Konami Digital Entertainment Co., Ltd. (Konami) have developed this Privacy Policy (Policy) for us to appropriately handle your Personal Data and will handle such Personal Data in accordance with applicable data protection and privacy laws (Applicable Laws) and this Policy.

In this Policy, Personal Data means Your personal data or personal information, details of which shall be as provided in Applicable Laws. For example, if you reside in the EU, Personal Data under this Policy means the “personal data” as defined in the General Data Protection Regulation of the EU.

1. Compliance.

When collecting and using Personal Data, Konami will respect and comply with Applicable Laws.

2. Inform.

Konami will tell you clearly, openly and honestly about the reasons and purposes for collecting and using your Personal Data, in accordance with Applicable Laws.

3. Security.

Konami will use strong security measures to keep your Personal Data safe and secure, as further explained below.

a. Organizational Measures

Confidentiality and Training: Konami will always make sure that our staff agree to ‘confidentiality obligations’ (meaning they promise to keep your personal data secret) in our employment contracts with them or our internal company rules applicable to them (Internal Rule), and we will train our staff on the importance of protecting your Personal Data and our obligations under Applicable Laws and our Internal Rule.

Reporting: Konami will appoint a person in charge of the use of Personal Data, manage carefully the staff who can access your Personal Data, and develop a reporting system so that any incident that may affect your Personal Data will be reported to the right person at the right time.

b. Technical Measures

Konami stores Personal Data it controls in a server housed in a physically secure data centre or a cloud server and backs it up on a regular basis, and has very strict controls for who can access your Personal Data.

Servers used to store your Personal Data use robust operating systems and implement network intrusion detection systems.

We also encrypt any data that require protection or that are transmitted on a network to protect them from unauthorized access, copy, modification, or deletion.

4. Managing Contractors.

When Konami uses third-party service providers (Contractor) in using your Personal Data, Konami will do the following.

a. Risk Assessment

Before sharing your Personal Data with our Contractor, Konami will assess possible risks brought by such sharing, by checking if such Contractor has a certification for conforming to the requirements of the information security management system standards or by requesting such Contractor to answer our questionnaire about their information security control measures (Contractor Security Measures).

b. Audit

Konami will conduct an audit of Contractor Security Measures as necessary.

5. Data Incidents.

Konami develops Internal Rules for us to appropriately analyse the impact on you in case of any Personal Data-related incidents, and to send necessary notifications or reports based on such analysis.

Where such incidents pose a potentially significant risk to you, then we will notify and/or report such incident in situations where Applicable Laws require Konami to do so, so that you can take appropriate steps to protect yourself from the breach.

6. Data Transfers.

When Konami transfers your personal data to countries outside the country or region that you reside in (Foreign Country), we will comply with the strict requirements imposed on us by Applicable Laws to ensure that your personal data remains protected to the same high standards.

For example, in Japan where Konami is located, the Applicable Laws of Japan require us to (i) acknowledge the Foreign Country in which we store your Personal Data and any systems (such as laws) on the protection of personal information of such Foreign Country, and (ii) take appropriate security measures based on the foregoing.

Since the requirements for data transfers differ from country-to-country, please contact us (see Section 7) for more information on the measures that we take for any data transfers.
